RENTAL TERMS OF SERVICE

These Rental Terms of Service describe the policies of Akademos, Inc. and its subsidiaries and affiliated companies (“Akademos”, “us”, or “we”) with respect to Akademos.com and related sites operated by Akademos, Inc., including, but not limited to, TextbookX.com and partnered school-branded TextbookX.com websites (collectively, the “Sites”) with respect to rental of textbooks and electronic materials. References to “you” or “your” in these Rental Terms of Service mean you as a renter of such items through the Sites. By renting an item through any of the Sites, you agree to the following Rental Terms of Service.

Privacy of Personal Information

When you place a textbook order with us, we ship your book from our warehouse inventory or from third-party providers who make rentals available through the Sites. Such providers will have access to your shipping address for the purposes of shipping your order, as well as your email address to support post-transaction communications, such as rental return notifications. At no time do these providers have access to credit card or other financial information as entered on TextbookX.com, and they are permitted to use your email address only for the purpose of providing customer service on your order. Please review our Privacy Policy for a description of the ways we may share your information with third parties.

Condition of Books

Books rented from the Sites are guaranteed to be correct according to your order and in an acceptable used or new condition. Supplemental materials, such as student access codes, CD ROMs, or supplemental workbooks are not guaranteed to come with your books even if the title of the book contains language regarding CD ROMs or other forms of supplements. Although we do our very best to find books that include all their supplements, many such materials are one-time use and are not available through our suppliers in used condition. Be sure before you order that you either have access to these supplements or that you don't actually need them for your class before renting textbooks that do not explicitly provide the access codes you need for your course.

Shipping

We rely on the expertise of our shipping providers, which are USPS, UPS, and FedEx, to get your books to you on time. Rare problems such as weather delays, rural routes, or shipping carrier system delays could impact delivery. Should a problem arise, we will work to resolve the delivery problem or send out a replacement textbook at no cost to you. Please refer to our customer service page for details on how to get help with delivery issues.

Ownership

Books rented through the Sites remain the property of the party from whom you rented them. At no time during the rental period do you obtain ownership of any book unless you purchase the book during the rental period or we charge you for the book because you failed to return it in accordance with these Rental Terms of Service.

Agreement to Return Books

You agree to return rented textbooks to us or our rental partners according to the specific instructions provided during your rental period, using the prepaid shipping label you received at the initiation of your rental agreement, on or before the last day of your rental period. Books that are not returned to the specified returns center will not be cleared from your account. Please make sure you are using the supplied prepaid USPS shipping label to return all books. Shipping labels are provided free of charge and provide definitive tracking of your returned books. You can access return labels and manage your rentals by logging into your account. Rental textbooks are not returnable for a refund.

Books Not Returned on Time

We will do our best to make returning your books simple and easy. However, if you fail to return any book on time and otherwise in accordance with the rental agreement and these Rental Terms of Service, we may automatically charge an extension fee, or charge you the replacement cost of the book. Replacement charges will be less any rental price and fees already paid. Once replacement charges have been processed, the book will then become yours to keep. Returned items must be postmarked on or before the rental return date. Returns with post-marks after the rental return date may be subject to a replacement charge. If your credit or debit card cannot be charged for the price of the non-returned book, we may advise your college to deduct the amount from your account, either through a financial aid withdrawal or a bursar’s charge. We also reserve the right to take legal action or engage a collections agency to enforce our rights.

We work very hard to resolve every return discrepancy. After all, our goal is to keep you as a happy customer and continue to rent textbooks to you throughout your college career.

Payment Information and Authorization

You authorize us to charge any amounts owed by you under these Rental Terms of Service to the payment method you used to rent the textbook or, if such payment method is no longer valid, to any other payment method we have on file in your account with us. You agree to maintain in your account at least one valid card that expires no earlier than 150 days after the date on which you rent the textbook. We reserve the right to block or cancel orders and suspend or terminate your account if you incur outstanding and unpaid fees for rented textbooks and we are not able to charge such fees to any payment method on file.

Maintenance and Care of Textbooks

You, the renter, agree to keep textbooks in an acceptable used condition. From the time you receive your books from us, you are fully responsible for maintaining them. If any book you rent from us is lost, stolen, or damaged beyond reasonable use (cover ripped off, pages torn out, excessive water damage, etc.), we will charge you its full replacement value. We and our rental partners understand that there will be normal wear and tear on a textbook during a rental period. Excessive damage is any damage that would prevent another student from reasonably being able to use and gain the full learning value from the textbook.

Buying Your Books

If you decide you want to keep your book, simply access your account and select the book or books you wish to buy. Then select the "Buyout" button. This amount is the difference between what you already paid in rental fees and the replacement value of the book. If you decide to purchase the book, simply follow the prompts after choosing this option and your account will be updated to show the new status. 

Pricing

"List Price" is the suggested retail price provided to us by the publisher, manufacturer or seller. Actual retail prices in your area may vary. "You Save" reflects the difference between our price and the publisher-provided list price shown on our sites. We cannot guarantee the price of an item until you order, as limited availability of certain items may be impacted by other shoppers on our site. The price information provided is not intended to and shall not be deemed to constitute a contract or an offer to form a contract, but is an advertisement for an offer. We do not charge your account until after your order has been placed and entered into the shipping process.

Use by Persons Located Outside the U.S.

We do not ship to addresses outside the United States. You acknowledge that the Sites and the Services are intended to be accessed and used by individuals located in the U.S. and that we make no representation that the Sites or the Services comply with the laws, including any privacy or data-protection laws, of any other jurisdiction.

Right to Cancel Orders

We and our rental partners retain the right to cancel or refuse any order that results from an error in pricing due to typographical errors, miscommunication with our partners, or any other incorrect information.

Limitation of Liability, Disclaimer of Warranties, Mandatory Arbitration, and Indemnification

Please review our Terms of Service for important information about the limits of our liability to you, our disclaimer of warranties, our mutual agreement to arbitrate disputes, and your obligations to indemnify us.

Changes to these Rental Terms and Conditions

We may notify you of changes to these Rental Terms and Conditions at any time by changing the date at the top. Any changes will be effective upon posting of the updated policy. Your rental of any materials from us following any change to these Rental Terms and Conditions constitutes your consent to such change.
